Side-by-sides—also called utility terrain vehicles (UTVs)—have surged in popularity across South Carolina. From trail riding and farm work to weekend adventures, these rugged, off-road machines offer fun and utility for riders of all ages. But until now, South Carolina’s laws haven’t kept pace with how people want to use them, especially when it comes to riding on public roads.
That could be changing thanks to a new bill introduced in the South Carolina General Assembly that would finally allow certain UTVs to be registered for limited road use—bringing both new opportunities and important insurance considerations for owners.
What the Proposed Bill Would Do
The legislation—often referenced as House Bill H 3293 / Senate Bill S 222—seeks to amend state law to define UTVs and create a legal pathway for them to be registered and operated on select roadways. Here are the key points:
🔹 Defines UTVs (side-by-sides)
The bill clarifies that a UTV is a four-wheel, side-by-side off-road vehicle designed to carry people and cargo with a steering wheel, top speeds above 35 mph, and certain size and weight limits.
🔹 Establishes registration & insurance requirements
Owners would have to register their UTVs through the SC Department of Motor Vehicles and show proof of liability insurance as part of that process—much like registering a car or truck.
🔹 Sets where and when UTVs can be operated
Once registered, UTVs could be legally driven during daylight hours on secondary highways and streets with posted speed limits of 55 mph or less, and within a certain radius of the owner’s home or community.
🔹 Requires drivers to be licensed
Operators would need a valid driver’s license, and proof of registration and insurance must be carried while driving.
Supporters of the bill say it would finally bring South Carolina in line with other states that already allow UTV road use, under certain conditions, helping riders move between trails, events, and rural locations more easily.
Why This Matters for Insurance
If this bill becomes law, it would mark a significant shift—not just for riders, but also for insurance considerations:
1. Liability Insurance Becomes Mandatory
Under the proposed law, proof of liability insurance is required before a UTV can be registered for road use. This means owners would need a policy specifically covering their UTV for both on- and off-road operation.
2. Coverage Needs May Change
Standard auto policies don’t always cover UTVs, and recreational policies may not meet the requirements for road use. Riders should talk to an insurance agent to ensure their policy includes:
-
Bodily injury and property damage liability (required for registration)
-
Coverage limits that meet DMV requirements
-
Optional collision and comprehensive coverages to protect the vehicle itself
3. Proper Coverage Protects You & Others
In the event of an accident, having the right insurance can protect you financially—paying for damages you’re responsible for and covering legal costs. It’s also a legal safeguard for everyone sharing the road.
Tips for UTV Owners in South Carolina
Even before this law is finalized, here are a few steps every side-by-side owner should take:
✅ Check your current coverage.
Talk with your insurance agent to confirm what’s covered and whether you’ll need a separate UTV policy or endorsement.
✅ Understand vehicle classification.
Not all off-road vehicles qualify as UTVs under the proposed bill. Side-by-sides that fit the definition may be eligible; traditional ATVs typically are not.
✅ Follow safety guidelines.
Whether on trails or roadways, good safety practices—helmets, seat belts, and proper training—reduce risks and may help lower insurance costs.
✅ Stay updated.
Legislation evolves. Follow local news and official state resources to know when this bill moves forward and how that could impact your rights and responsibilities as a rider.
